This privacy statement (or “policy”) explains how SearchUnify (“SearchUnify,” “we,” “us,” or “our”) collects, uses, and processes the information of individuals visiting our website, www.searchunify.com (the “Site”), and through the services available via our products.

The privacy statement applies to users (“you”, “your”, or “yourself”) including (i) customers having access to our products; (ii) individuals attending webinars, events or training sessions; and individuals visiting all internet sites operated by us and using our services. By using our services, you agree that your information will be governed as described by this policy and that your usage of our website and products with any disputes arising thereof over privacy are subject to this policy and our Terms of Service (“Terms”) which are incorporated by reference into this policy.

All categories of Personal Information shall be processed consistent with the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and in accordance with IT industry standards and any other applicable laws. 

We consider it our duty to be transparent, in relation to the data collected and its utilization. We make sure that all data is acquired with consent when necessary unless required by law, and is processed fairly in a lawful manner with transparency safeguarding the rights of those accessing our services. Accordingly, we have developed this privacy statement to help you understand what information we collect, why we collect it, how we use it, and how you can update, manage, export, and delete your Personal Information.

DATA COLLECTION AND USES

Information We Collect

We may collect your Personal/Non-Personal Information from or about you, depending on the products, solutions, and services you use or query. The information we collect and how that information is used, may vary as per your usage of our products and services.

We also collect and store content that you create, fill, submit, post, provide, transmit, save or display in the process of using our products and/or websites. Such content may include Personal Information or other sensitive information that you choose to include.

  • Personal Information – Personal Information means information that identifies you or can be used to identify or contact you. Such information may include your name, address, email address and telephone number. We shall collect personally identifiable information from you voluntarily and only after appropriate consent.
    • We collect the Personal Information you provide – such as your name, username, or business/personal email address, contact and other related information – when you contact us, participate in an online survey, use our product(s), solution(s) and service(s), create an account, request for demos/trials/sign-ups/attend webinars, participate in community discussions or chat rooms on other platforms, apply for employment, interact with us at in-person events, or otherwise interact with us. Furthermore, we also get information when you register on our website/product and willfully provide us your information like business/personal email, contact and other information related to your account.
    • We collect Personal Information in connection with the purchase of services or products from us. This information includes payment information such as first name, last name, business/personal email address, and billing and contact details.
      Note: We do not store credit card details related to any transaction with Grazitti Interactive and its affiliates (“Grazitti”).
    • We may collect information from third parties, including business partners and data providers. This includes your contact information to offer certain products and services on the basis of the consent you have provided to the respective data providers. However, we will again ask for consent before connecting with the contact person.
  • Non-Personal Information – We may collect Non-Personal Information. Non-personal Information means the data which cannot be used to identify or contact you, such as demographic information (like age, profession or gender). Non-Personal Information may also include user IP addresses, browser types, domain names, and other anonymous statistical data. We may also collect information like geolocation and customer activities like most searched/frequently visited pages on our website and from our other products and services.

    When you visit our website or cloud-based product(s), we may use third-party tools to gather generic data and user-behavior information like:

    • The browser type and version used
    • The operating system used
    • The website from which an accessing system reaches our website (so-called referrers)
    • The sub-websites
    • The date and time of access to the Internet site
    • An Internet protocol address (IP address)
    • The Internet service provider of the accessing system

We do not store any Personal Information with your use of the SearchUnify website (www.searchunify.com), but we store the information we collect with unique identifiers tied to the browser, application, or device you’re using. This helps us enhance your browsing experience.

  • Sensitive Data – We do not seek to collect Sensitive Data through the SearchUnify website or otherwise. Unless otherwise agreed upon, you shall not submit any Sensitive Data (including PHI, PCI) regulated by any applicable federal or state laws, rules or regulations. In the cases where SearchUnify is required to process the sensitive data as per the signed agreement between both parties, the processing will be performed in accordance with Company’s documented instructions and in accordance with data privacy law requirements.

When you’re signed in to the SearchUnify product, we collect information that we store with your SearchUnify Account, which we treat as Personal Information and store as per technical and organizational measures outlined under the applicable law(s).

How Do We Use Your Personal Information?

While processing the acquired Personal Information, SearchUnify makes sure that it does not affect the basic privacy or legal rights of the individual. SearchUnify may use Personal Information for the following purposes:

  • SearchUnify has integrated the component of custom analytics (with the anonymizer function). SearchUnify’s Analytics tool collects and analyses the data to know the behavior of the user’s searches. Analytic data helps companies know the user behavior to provide their customers with better user experience in a more efficient way.
  • To provide, operate, maintain, improve, and promote SearchUnify Services to our clients/visitors. The information may also help you in accessing and using our services including downloading, uploading, content sharing and collaborating;
  • To respond to your requests, questions, queries, and comments; to provide customer support; to send you security alerts and updates;
  • Provide law enforcement authorities with the information necessary in case of criminal activities, security incident/breach, or a cyber-attack;
  • Subject to your prior express consent, we may use Personal Information to send you marketing communications in relation to our products and services; communicate with you about the services or products Grazitti is providing under the agreement; and inform you about our policies, terms and latest updates.

Hence, SearchUnify analyzes the collected data and information statistically, with the aim of improving the data protection and data security of our services, products, and its users to ensure an optimal level of protection for the Personal Information we process.

Your prior express consent is required for any of the uses of your data described above, and you may withdraw your consent by writing an email to privacy@searchunify.com.

Cookies, Newsletters, and Third-Party Services

Cookies

SearchUnify website and product may use “cookies”. A cookie is a small piece of data sent from a website/application and stored on the user’s computer by the user’s web browser while the user is browsing. We collect this information to provide a better user-journey of our website and to enhance the overall experience of our website and products.

We use two types: persistent cookies and session cookies. A persistent cookie helps us recognize you as an existing user. A persistent cookie stays in your browser and will be recognized by SearchUnify upon your return to the site. Subscription To Newsletters

Upon visiting the SearchUnify website, users are given the opportunity to subscribe to our enterprise newsletters and regular emails after providing consent. The newsletter may only be received if you have opted in for it. Each newsletter comes with a link providing the user with the option to opt-out of the service.

The newsletter contains tracking pixels that provide us the information if and when an email was opened. Such data collected in the tracking pixels are used to analyze and optimize the shipping time of the newsletter and to improve the content of future newsletters as per the interests of the receivers.

Third-Party Services: 

We may use third-party services when you use our services/products, including YouTube API Services. While you have the option to connect with these third-party applications, we are not responsible for their privacy practices or content. We connect to YouTube using OAuth authentication and do not store any personal information of the authenticating users in our system.

Your use of third-party applications shall also be subject to the third-party’s privacy notices currently found at https://www.youtube.com/t/terms and http://www.google.com/policies/privacy. Please contact these third-parties directly for information regarding their privacy practices prior to providing them with any information. 

Additionally, you can revoke the API Client’s access to your data by visiting the Google security settings page at https://security.google.com/settings/security/permissions

INFORMATION SHARING AND DISCLOSURE

We do not share your collected information with any third-party as such. However, we may share the information internally within the departments. We can use your data for marketing purposes if you opt-in while giving your consent. We make certain Personal Information available to strategic partners that work with us. Personal Information will only be shared by us with these companies in order to provide or improve our products and services; it will not be shared with third parties for their own marketing purposes without your prior express consent.

3.1 Affiliates

We may share Personal information with all Grazitti affiliates. For the purposes of this Privacy Statement, two entities are “Affiliates” if both of the entities are controlled/owned 50% or more by the same owner(s).

3.2 Service Providers

Grazitti is in contract with third-party auditing companies and may make available some information during external audits, to show its compliance with the applicable law(s). These companies are obligated to protect your information. All the information shall be provided on a need to know basis and for only the specific purpose. 

3.3 Legal Compliance And Security

It may be necessary – by law or as a result of a legal process, or requests from public or governmental authorities within or outside your country of residence – for us to disclose your Personal Information.

Grazitti is obliged to share your Personal Information under any/all applicable and judicial laws with/without your consent if we determine that for purposes of disclosure is necessary or appropriate.

Note: Grazitti and SearchUnify do not sell your Personal Information.

DATA SECURITY, INTEGRITY, AND RETENTION

Grazitti is compliant to ISO27001, ISO27701, HIPAA and SSAE21 SOC1 SOC2. The security, integrity, and confidentiality of your information are extremely important to us. To ensure the safety of your information we have implemented reasonable, technical, administrative, and physical security measures. Considering the potential risks to data, we conduct VAPT from third-party and perform regular internal/external audits. Where applicable the below scenarios:

  • If you use a third-party cloud server to host our product and have all the access with you then, responsibility for securing storage and access to the information you put into the Services rests with you and not Grazitti.
  • If you use a third-party cloud server to host our product and take our product support services only then, the responsibility for the product lies with us. But securing the data, server access, the data storage, and server maintenance rests with you and your hosting company.
  • If you use a third-party cloud server to host our product and take our services to manage the server then, the responsibility for securing the server credentials and access to the information lies with us.
  • If you use our products hosted on a server managed by us then, it’s Grazitti’s responsibility to implement the security measures to keep your data secured.

If you feel that the security of your Personal Information has been compromised, please contact us immediately at privacy@searchunify.com. Please be aware that, despite our best efforts, no security system is impenetrable. In the event of a security breach, we will promptly notify you and the proper authorities if required by law.

Other Sites

The Services may contain links to other websites or services. We are not responsible for the privacy practices or the content of such websites or services, and you should review the privacy policy of each such website or service to make sure that you are comfortable with it before providing any Personal Information. As discussed above, we do not receive any banking information you provide to our third party payment processors, and all such information is subject to their privacy policies.

Data Retention And Deletion

Grazitti will retain Personal Information acquired from you for a predetermined period necessary to fulfill the purpose for which it was intended and/or for performing or fulfilling contractual obligation with your organization. You have the right to request for data erasure at any time with reference to point “Right to Erasure” under your rights. The criteria used to determine the period of storage of Personal Information is the respective statutory retention period. After the expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the initiation/fulfillment of the contract.

YOUR RIGHTS ON YOUR INFORMATION

This section explains what rights you have in relation to our processing of your Personal Information. For more information about these rights, or to submit a request, please email privacy@searchunify.com with the subject of the email clearly identifying the purpose of the email. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Information: if necessary to verify your identity and the nature of your request.

  • Right Of Information and Access: You have the right to obtain information about and access to your Personal Information that we process in accordance with the applicable law(s). Furthermore, you have a right to obtain information as to whether Personal Information is transferred to a third country or to an international organization. Where this is the case, you have the right to be informed of the appropriate safeguards relating to the transfer.
  • Right to Rectification: If you believe that any Personal Information we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can also correct some of this information directly by making changes to your Profile. Additionally, we shall be sending emails annually asking for any rectifications or updates of your Personal Information. Information shall be stored and processed on the basis of the latest email received from your registered email address. (Please note that this shall also imply a renewal of consent for storing and processing of Personal Information.)
  • Right to Erasure: You can request that we erase some or all of your Personal Information from our systems. You have the right to request the erasure of your Personal Information where one of the following grounds applies:
    • The Personal Information is no longer necessary in relation to the purposes for which they were collected or otherwise processed.
    • The data subject objects to the processing and there are no overriding legitimate grounds for the processing.
    • The Personal Information has been unlawfully processed.

If one of the aforementioned reasons applies, and you wish to request the erasure of Personal Information stored by us, you may request the same.

  • Withdrawal of Consent: If we are processing your Personal Information based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time and in accordance with this privacy policy. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Information: if such use or disclosure is necessary to enable you to utilize some or all of our Services. 
  • Right to Portability: You can ask for a copy of your Personal Information in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.
  • Right to Object: You can contact us to let us know that you object to the further use or disclosure of your Personal Information for certain purposes, such as for direct marketing purposes. You have the right to object to the processing of your Personal Information. We will no longer process your Personal Information in the event of the objection being raised unless we can demonstrate compelling legitimate grounds for the processing.
  • Right to Restrict Processing: You can ask us to restrict further processing of your Personal Information. Such restrictions can limit the ways in which data can be processed by Searchunify. Restriction can be imposed if there are issues with the content of the information or how we have processed your data. In most cases such restrictions are not for an indefinite time period, but are in place till the issue has been addressed.Your access to SearchUnify services might be limited until such restrictions are resolved. This is because while availing SearchUnify services, certain Personal Information is required to be processed so as to ensure an optimum user experience.
  • Right to File Complaint: You have the right to lodge a complaint about SearchUnify’s practices with respect to your Personal Information with the respective supervisory authority. 

EU Residents’ Rights

If our processing of your Personal Information is subject to the European Union General Data Protection Regulation (“GDPR”), you have the following rights with respect to your Personal Information:

  • Right of access: You can request information about your Personal Information that we process in accordance with GDPR article 15. 
  • Right of rectification: You have the right to rectify inaccurate Personal Information concerning you in accordance with GDPR article 16. If your data is incomplete, you may request that it be completed. Taking into account the purposes of the processing, you have the right to have incomplete Personal Information completed.
  • Right to erasure: You have the right to request the deletion of your Personal Information in accordance with GDPR article 17.
  • Right to restrict processing: In accordance with GDPR article 18, you have the right to request a restriction of processing your Personal Information.
  • Right to data portability: You have the right to receive your Personal Information that you have provided to us in a structured, common and machine-readable format as well as the right to transfer this data to another data controller, if the conditions of GDPR article 20.1 (a), (b) are met.
  • Right to object to processing: In accordance with GDPR article 21.1, you have the right to object, for reasons arising from your particular situation, to processing your Personal Information on the basis of GDPR article 6.1 (e) or (f). We will no longer process your Personal Information in the event of the objection being raised unless we can demonstrate compelling legitimate grounds for the processing.
  • Right to withdraw your consent: If you have given your consent for processing, you have the right to withdraw your consent to processing Personal Information at any time in accordance with GDPR article 7.3.
  • Right to file a complaint: In accordance with GDPR article 77, you have the right to file a complaint with a data protection supervisory authority about our processing of your Personal Information.

California Residents’ Rights

If our processing of your Personal Information is subject to the California Consumer Privacy Act (“CCPA”), you have the following rights with respect to your Personal Information:

  • Right of information and access
  • Right to erasure
  • Right to opt-out of the sale of your Personal Information
  • Right to non-discrimination

You may contact SearchUnify at privacy@searchunify.com and include “CCPA Rights Request” in the subject line of the request to exercise your rights. We will do our best to respond to your inquiries within 30 days.

Other Rights

You may reside in a country not covered by the above privacy laws. In such cases, we have put in place the appropriate measures to ensure that your Personal Information will be secure according to the laws of the country in which you reside. To make such a request, you may contact SearchUnify at privacy@searchunify.com and include the “privacy law of the country of your residence” in the subject line of the request to exercise your rights under the applicable data privacy law. SearchUnify will treat your request in accordance with applicable law. We will do our best to respond to your inquiries within 30 days.

CHILDREN’S PRIVACY

Our products and services are intended for adults. Therefore, we do not knowingly collect or solicit Personal Information from anyone under the age of 16. If you are under 16, please do not attempt to register for the Services or send any Personal Information about yourself. If we learn that we have collected Personal Information of a child under age 16, or the equivalent minimum age depending on the jurisdiction, we will delete that information as quickly as possible.
